The Supreme Court has upheld the judgment of the Court of Appeal which ruled that Senator Peter Nwaoboshi is the winner of the People’s Democratic Party (PDP) senatorial primary election for Delta North, held on October 2, 2018.
This puts to rest the earlier judgment of the Federal High Court Abuja which declared Prince Ned Nwoko winner of the said primary.
The five man panel of justices which was led by Justice Inyang Okoro dismissed the suit for lack of jurisdiction.
The Federal High Court in Abuja on the 3rd of April 2019, declared Ned Nwokwo as the true candidate of the PDP for the National Assembly election which held on the 23rd of February 2019.
However, the Court of Appeal in Abuja had reversed the April 3, 2019, judgment of the Federal High Court, Abuja, which sacked Senator Nwaoboshi as the candidate of the Peoples Democratic Party for Delta North Senatorial seat.
Nwoko proceeded to the Supreme Court to challenge the decision of the Appeal Court.
