PDP refutes rumors of withdrawing election petition from tribunal

Media reports that the People’s Democratic Party (PDP) had withdrawn its petition to the Presidential Election Tribunal have been discredited.

This was stated in a statement that Mr. Debo Ologunagba, the PDP’s National Publicity Secretary, released on Thursday in Abuja. In the statement, Mr. Ologunagba called the reports “false and reprehensible fabrication.”

The PDP makes it clear that our party and Atiku Abubakar did not withdraw our petition to the Presidential Election Tribunal against INEC, APC, and Tinubu.

However, the PDP wishes to clarify the following for the benefit of our hordes of members, supporters, and the general public:
“The Legal Team of Atiku Abubakar, led by J.K. Gadzama, SAN, appeared in court on Monday, March 13, 2023, to move a Motion Exparte and an Affidavit of Urgency (CA/PEC/12M/2023).

He stated, “The motion sought orders directing INEC to permit us observe/participate in the process of sorting out the ballot papers used for the Presidential, Senatorial, and House of Representatives elections conducted across the country on Feb. 25.”

He went on to say that the court asked PDP to change its Motion Exparte to a Motion on Notice, to serve it on the parties (INEC, APC, and Tinubu), and to return on Wednesday, March 15, for a hearing of our Motion on Notice. The court wanted to make sure that everyone was on notice.

“Our Legal Team held a conference meeting with the INEC Legal Team on Tuesday, March 14, 2023.

“The commission gave its affirmation to help out our group during the investigation and figuring out of voting form papers, and to likewise give political decision materials expected to document our appeal.

“There was no longer a need to proceed with the hearing of the Motion on Notice (CA/PEPC/13M/2023) due to this agreement with and assurance by INEC.”

As a result, our team submitted a Notice of Discontinuance for the mentioned Motion.
According to Ologunagba, the PDP Legal Team returned to the Court on Wednesday, March 15 to inform the Court of the agreement reached with INEC and the formally discontinued Motion on Notice against all Parties (INEC, APC, and Tinubu).

“The PDP is therefore on the right track, and we are determined to pursue the case to its logical conclusion, which is the revocation of our Presidential mandate at the Tribunal,” the PDP stated.

He stated that the PDP valued the concerns of millions of Nigerians regarding the false report, which demonstrated the widespread support for Atiku Abubakar and the PDP in the February 25 presidential election.
